asked the Minister for Local Government if he is aware that planning permission was given for the opening of a coffee shop at Lakelands Road, Stillorgan, County Dublin subject to the condition that the shop should not be used as a fired fish and chip shop; that this shop is now in fact selling chips; and if he will take steps to ensure that the planning restriction is not violated.

I am aware that planning permission was granted on appeal on 7th April, 1971, for the use of a shop at Lakelands Road, Upper Kilmacud Road, as a coffee shop and that a condition was attached to the permission requiring that the shop be not used as a "fried fish and chip" shop. The enforcement of planning control is fundamentally a matter for the planning authority and it is for them to determine in the first instance whether the sale of chips as distinct from "fried fish and chips" would contravene this condition.
