(Cavan) asked the Minister for Justice when it is proposed to appoint a Master of the High Court; and if he will make a statement on the matter.

The appointment of a Master of the High Court is a matter for the Government, who have decided not to fill the present vacancy pending consideration by them of recommendations made to me by the Committee on Court Practice and Procedure in their sixteenth interim report in regard to the jurisdiction of the Master of the High Court. I have made copies of the report available in the Library.

With a view to making the fullest possible use of the Office of Master of the High Court in the judicial sphere, the committee recommend a substantial increase in the present jurisdiction of the Master. Moreover, they consider it essential that the jurisdiction of the Master be conferred by statute. A general scheme for a comprehensive Courts and Court Officers Bill to implement the recommendations of the committee is now being discussed with the various interests concerned. I hope to have the matter considered by the Government at an early date.

The Government are satisfied that an appointment to the present vacancy should not be made in advance of legislation spelling out the new duties of the Master of the High Court. In the meantime, the present duties of the Master are being discharged by a Deputy Master appointed by me under section 27 of the Court Officers Act, 1926. As Deputies will be aware, a short Court Officers Bill is now awaiting Second Stage in the Seanad. This Bill is designed to enable me to continue in office the Deputy Master until the comprehensive legislation is enacted.

In view of the unsatisfactory nature of the reply to Question No. 96 I want to give notice that I wish to raise it on the Adjournment.

The Deputy appreciates that it is too late for today.

I appreciate that, but I want to be in first for the next day. The reason is that I have got two notices here giving very significant instructions to the Garda which the Minister says he never issued.

The Deputy can give notice on Tuesday next.
