Vol. 261 No. 10

Ceisteanna—Questions. Oral Answers. - Teacher Suspension Inquiry.

57.

asked the Minister for Education the findings of an inquiry held into the suspension of a person from his position as a teacher (details supplied); if the report included all aspects of the case including the time prior to the teachers' strike; and if the Department have yet sanctioned the Dublin City VEC's award of the special allowance to this person.

The findings of the inquiry were to the effect that the teacher refused to obey a lawful order of his employer, the City of Dublin Vocational Education Committee, but that he believed that he was justified in following the course of conduct of which evidence had been given in the inquiry. The report covered all aspects of the case appropriate to the terms of reference. As the qualification for which a special allowance was claimed in this case does not reach the required standard, it is not open to my Department to sanction the award of the special allowance in accordance with the relevant regulations and its award has not, therefore, been sanctioned by my Department.

Is the Minister aware that this person feels aggrieved at the fact that the report did not deal with all aspects of the case, including the time prior to the teachers' strike?

I think I dealt with it.

The Minister said it dealt with the terms of reference. Did the terms of reference cover the time prior to the strike?

So far as I am aware they did, but I am not absolutely certain.

If he finds they did not would he look into it again?

I am sorry.

The Deputy need not be sorry. I have called Question No. 58.

I did not get an answer. It is not 3.30 yet and on Thursday I think I could ask for it on the Adjournment.

If the Deputy so wishes.

I shall raise the matter on the Adjournment.
