asked the Minister for Industry and Commerce if he is aware that CIE charged the new prices for a type of cigarette (details supplied) on the 9.30 train from Heuston Station, Dublin to Cork on 18th January, 1975; and the action he intends to take on the matter.

Inquiries made by my Department have established that increased cigarette prices, which did not become effective until 22nd January, 1975, were charged by CIE on the train referred to. The company will refund any overcharge on application.

What action does the Minister intend to take in this matter? Does he intend to prosecute CIE?

I understand that the person about whose complaint I have information declines to offer evidence.

I have somebody who will give evidence. I know of small huckster shops which are being persecuted by the ill-mannered inspectors of the Minister's Department.

The Deputy is making a statement now.

While this is happening a State company can overcharge and will not be prosecuted. The person who made the complaint to me is a shopkeeper and he is prepared to give evidence if the Minister will prosecute CIE.

If the Deputy can bring forward evidence I will have the matter considered.

In other words, there is one law for a State body and another for the ordinary private individual.

Certainly not.

I know of a case where for the sake of two halfpence it has already cost the State £80 to prosecute one man and the Minister will not prosecute this State company which deliberately broke the law.
