Vol. 281 No. 2

Ceisteanna—Questions. Oral Answers. - Moneylenders Act.

37.

asked the Minister for Justice when it is proposed to initiate legislation to amend the Moneylenders Act, 1933.

38.

asked the Minister for Justice the response, if any, he has received to his invitation to community associations to make submissions for amending the Moneylenders Act, 1933.

(Cavan): With the permission of the Ceann Comhairle, I propose to take Questions Nos. 37 and 38 together.

In reply to a parliamentary question by the Deputy on 16th May, 1974, I indicated that it would be necessary to make a minor amendment of the Moneylenders Act, 1933—relating to a citizenship provision—to comply with our EEC obligations and, in that context, any other amendment that seemed desirable could be introduced. I asked that any interested organisation should send in their views, preferably in writing, within six weeks or so.

Since I answered that question certain judgments of the Court of Justice of the European Communities have determined that the relevant provisions of the EEC Treaty are directly applicable. The resulting situation may affect a number of enactments and accordingly the Attorney General is considering what may be necessary by way of revision of the Moneylenders Act, 1933 and certain other enactments.

In response to my request for the views of interested organisations, one community association submitted a memorandum, which is being examined.
