asked the Minister for Local Government his reasons for refusing the appeal of the Glenview Gardens Residents' Association, Limerick against the granting of planning permission for building on an open space at Glenview Gardens which is used by the residents for sporting and recreational purposes.

In my consideration of this appeal I had regard to the proper planning and development of the area and the development plan. I saw no reason to reverse the decision of the planning authority and made an order granting permission subject in general to the same conditions as those imposed by the planning authority. One of these conditions provided that no development shall be commenced until agreement has been reached between the developer and the planning authority restricting and regulating the development and use of the communal open space proposed by the developer. The housing is an extension of an earlier scheme and the open space to be provided complies with the terms of the development plan.
