asked the Minister for Local Government if he will initiate legislation to amend section 106 of the Housing Act, 1966 to ensure that if any building is not in good structural condition the State will accept liability for the repair.

The initiation of legislation along the lines proposed by the Deputy appear to be unnecessary.

Under section 106 of the Housing Act, 1966, a local authority is required to carry out such works as shall be necessary to put a dwelling into good structural condition prior to the sale of the dwelling. The authority may also be directed by the Minister to carry out such works, following consideration of a valid appeal from the purchaser. Works carried out under section 106 qualify for housing subsidy. The State is contributing by far the greater part of this subsidy and will be meeting its cost in full from 1st January, 1977.
