Vol. 288 No. 3

Ceisteanna—Questions. Oral Answers. - Stamp Duty and Rates.

15.

asked the Minister for Local Government if he will confirm that relief from stamp duty and remission of rates will continue to apply to those private houses for which a grant was formerly received from his Department.

I would draw the Deputy's attention to the announcement by the Government Information Services on 31st December, 1975, which stated that the Government have decided that the rates remission and exemption from stamp duty, hitherto enjoyed by grant-type houses, shall continue to apply to such houses and that proposals for legislation to give effect to this decision are being prepared. The situation is that they are.

What type of certificate—and by whom is the certificate issued—is presently acceptable to the Revenue Commissioners which will permit them to give this relief from stamp duty?

The Department of Local Government.

I understand that in some cases the Revenue Commissioners have demanded the stamp duty. I would like the Minister to make inquiries and, perhaps, let me know what the position is.

One of the Deputy's colleagues drew that to my attention a week ago. The Revenue Commissioners are now aware of the situation.

Can I take it that the Revenue Commissioners are not now demanding stamp duty in such cases?

I cannot honestly say, but they have been told the position and told they should not do it. If they have done so, the matter will have to be rectified.
