asked the Minister for Tourism and Transport if he is aware of the proposed closure of the British Rail Waterford/Fishguard service; the steps he has taken to prevent this; and if he will make a statement on the matter.

I am aware that British Rail have announced that they propose to close their Waterford/ Fishguard shipping service with effect from the 18th March, 1978, because of the losses incurred on the service.

I am, of course, concerned that our importers and exporters should have adequate shipping facilities at their disposal. The provision and maintenance of particular services is, however, a matter for the commercial interests concerned and I have no powers to ensure the continuance of any particular service.

Is the Minister aware that there is an Act of Parliament under which this service is run? Can he take steps now to ensure that this traditional and important service in relation to the carrying of freight between Waterford and Fishguard is maintained?

I pointed out to the Deputy the constraints in relation to this matter. I am aware of the fact that there is an Act of Parliament. I am equally aware that the Waterford Harbour Commissioners have initiated proceedings in the High Court in relation to the matter. Therefore, I do not think there is much more I can say about it.

Is the Minister saying that he has no powers under an Act which was enacted directly in relation to this service and which is, at least, effective in Ireland? If it has been rendered neutral by an order of the British Parliament, it is still effective here. Is he aware that he has powers and, if so, will he use them?

I do not accept that I have power in the sense that the Deputy has mentioned; neither did my predecessor.
