asked the Minister for Social Welfare why a person (details supplied) in County Westmeath has not been paid disability benefit, although his doctor has refused to certify him as fit for work.

The person named was in receipt of disability benefit from 16 July 1973. He was examined on 22 March 1977 by a medical referee who found him capable of work. His claim was disallowed from 4 April 1977 by a deciding officer and he appealed against that decision. Before his case was referred to an appeals officer, he was again medically examined, this time by a different medical referee, who also found him capable of work. The appeals officer decided that he was not incapable of work from 4 April 1977 and was not entitled to be paid disability benefit from that date.
