asked the Minister for Justice the total number of persons charged as a result of the new breathanalyser alcohol test; the number of convictions; and the number of persons, if any, suspended from driving as a consequence of conviction.

In respect of the period from the 20 July 1978, when the new Road Traffic (Amendment) Act came into operation, up to the end of October 1978 the figures sought are as follows:

(1) Number of persons charged: 898;

(2) Number of convictions: 98;

(3) Number of persons suspended from driving as a consequence of convictions: 91.

As these figures taken by themselves could be misleading, I would add two points of explanation. First, the relatively small figure for convictions is accounted for in the main by the fact that the great majority of the cases in which proceedings have been taken are still before the courts.

Second, disqualification is mandatory where the conviction relates to driving or attempting to drive a motor vehicle when the blood/alcohol level exceeds the prescribed amount but it is not mandatory where the offence does not involve driving but only being in charge of the vehicle.

Can the Minister indicate the number of cases remaining which could result in convictions and disqualifications?

I have not got that information in my brief but I will gladly get it for the Deputy if that is possible tomorrow.

Does the Minister feel the test should be amended?

That question might be put to the Minister for the Environment.

Has the Minister got any information on the number of dismissals?

No; but if I can get it I will send it to the Deputy.
