asked the Minister for Social Welfare why a person (details supplied) in County Meath, who has a full United Kingdom insurance record, is a native of Ireland and has returned here and is actively seeking work, has not been paid unemployment benefit while he is seeking work.

The person's claim to unemployment benefit fell to be determined under the provisions of the EEC regulations governing the social security of migrant workers. These regulations allow the reckoning of a social insurance record in another member state for unemployment benefit purposes only where the claimant has last worked in the country in which he claims benefit. Accordingly, the person concerned is not entitled to unemployment benefit as he has no Irish social insurance and his last employment was in the United Kingdom.

His entitlement to unemployment assistance is presently being considered and arrangements are being made to have his claim determined as early as possible.
