Vol. 315 No. 16

Written Answers. - Repayment of Army Gratuity.

39.

asked the Minister for the Environment the reason local authority employees are being asked to repay all or part of their Army gratuity to purchase "pension years".

The Local Government (Superannuation) Act, 1956 provides that a pensionable employee is not entitled to reckon as service for superannuation purposes any period in respect of which he has already received a gratuity under that Act, or under any other Act or scheme relating to superannuation, unless he repays such gratuity. Gratuities paid under the Defence Forces (Pensions) Schemes or the Army Pensions Acts must, accordingly, be repaid to enable Defence Forces service to be reckoned for superannuation purposes in conjunction with local authority service.
