asked the Minister for the Environment if an approved applicant for rehousing has the right to appeal to a higher authority against the decision of a county or city manager if the applicant feels aggrieved by the letting of a house.

There is no provision for such an appeal in section 60 of the Housing Act, 1966, as amended by the Housing (Miscellaneous Provisions) Act, 1979, which governs the letting of local authority dwellings. Under this section, the final decision on allocations rests with the housing authority. The letting of dwellings is an executive function which is discharged by the manager who must let the dwellings in accordance with the local scheme of letting priorities adopted by the elected representatives and approved by the Minister. While the Minister may vary a scheme made under the section, he is specifically precluded by section 60 (6) from directing the letting of a dwelling to any individual person.
