Vol. 327 No. 4

Written Answers. - Farm Mortgages.

254.

andMr. Keating asked the Minister for Justice if he will consider introducing legislation to provide that, where farms are mortgaged, a family home would be excluded from the scope of the mortgage so as to protect the interests of all family members.

I assume that it is not being suggested that legislation should purport to invalidate existing mortgages validly granted. As for future mortgages, I have heard no arguments to support the view that a restriction on the lines suggested would be in the best interests of farm families. No doubt it is appreciated that the protection of the Family Home Protection Act, 1976, extends to family homes associated with farms.
