asked the Minister for Industry, Commerce and Tourism if he will make an order under the appropriate legislation or introduce legislation, if necessary, to control the hours of trading of take-away shops, particularly those in residential areas.

I assume that the Deputy's question relates to take-away food shops and that he is concerned about noise and other nuisances occasionally associated with such shops in residential areas. I am satisfied that the great majority of take-away food shops provide a useful service without causing any nuisance. Where a nuisance persists, it could, more appropriately and effectively, be dealt with through the machinery of the courts which, I understand, has been availed of for this purpose in particular instances, rather than by way of legislation.
