asked the Minister for the Environment the proposals he has to control effectively the emission of noxious fumes from the exhausts of mechanically-propelled vehicles; and whether the controls will be enforced in respect of bus operators.

Regulations under the Road Traffic Acts require that mechanically propelled vehicles, including buses, must be so constructed, maintained and used as to prevent, to such extent as is reasonably possible, the emission of smoke, visible vapour, noxious gases, or offensive odours. The user or owner of a vehicle which does not comply with these requirements is guilty of an offence. Enforcement of the regulations is a matter for the Garda Síochána.

Annual roadworthiness testing of certain categories of vehicles, including buses, will be compulsory as from 1 January, 1983 and will require a smoke emission test for all buses and a carbon monoxide test for those which are petrol driven. The European Communities (Vehicle Type Approval) Regulations, 1980, gave effect to EEC Directives relating to standards required in relation to exhaust emissions from mechanically operated vehicles which can be allowed to be sold and used freely within the Community.
