asked the Minister for the Environment if he will make a statement on the loophole in the planning laws as it affects the Dublin Port and Docks Board.

I would refer the Deputy to the reply to Question No. 565 of 18 November 1981.

The Local Government (Dublin) Act, 1930, and the Local Government Provisional Order Confirmation Act, 1953, fixed this maritime boundary of Dublin County Borough at low water mark. Any development carried out beyond this boundary, i.e. on land reclaimed by infill, is strictly outside the jurisdiction of Dublin Corporation. I understand that under the terms of an agreement made in January 1972 the Dublin Port and Docks Board gave an undertaking that future developments in the port area would be carried out only in accordance with the terms of Harbour Works Orders made by the Minister for Transport and Tourism and that planning permission for any development (other than exempted development) would be applied for in accordance with the provisions of the Local Government (Planning and Development) Acts. I also understand that it is a condition of all leases of lands in the port that the lessee must obtain planning permission. The position in related to local authority maritime boundaries generally is being examined in my Department.
