asked the Minister for the Environment if he will arrange to have the transport fleet of a firm (details supplied) in County Offaly examined for roadworthiness under the appropriate legislation; and if he will outline the results of such investigations.

Since 1 January 1983 it is an offence to use certain categories of commercial vehicles in a public place unless they have passed a test and certificates of roadworthiness have been issued in respect of them.

Since 1 March last, a certificate of roadworthiness must be produced on the renewal of road tax on these vehicles. Testing of vehicles is carried out by authorised testers appointed by local authorities. Arrangements for such a test are a matter for individual vehicle owners who may apply to any authorised tester to have a vehicle tested. In addition to the testing requirement there is a statutory obligation on vehicle owners to maintain vehicles in a roadworthy condition at all times. Enforcement action to ensure compliance with these requirements is primarily a matter for the Garda Síochána.
