Vol. 344 No. 9

Written Answers. - Social Welfare Benefits.

555.

asked the Minister for Social Welfare the benefit which will be paid to a person (details supplied) in County Donegal.

The person concerned was disallowed payment of disability benefit from 17 November 1982 following examination by a medical referee who expressed the opinion that she was capable of work. She was examined on 24 May 1983 by a different medical referee who also considered her to be capable of work.

An appeal form has been issued to the claimant and she has been advised to return the form setting out the grounds for her appeal if she wishes her case to be referred to an appeals officer for determination.

556.

asked the Minister for Social Welfare when eight months' arrears of social welfare assistance will be paid to a person (details supplied) in County Wicklow.

A payable order for arrears of social assistance allowance for the period from 28 October 1982 to 27 April 1983, less deductions in respect of maternity allowance and supplementary welfare allowance paid to her during that time, has been sent to the person concerned.

557.

asked the Minister for Social Welfare when unemployment benefit at the full rate will be paid to a person (details supplied) in County Cork.

The person concerned repeated a claim to unemployment benefit on 14 April 1983, and payment of flat rate unemployment benefit at the maximum rate payable to him £68.05 weekly increased to £74.85 weekly from 30 June 1983 was made to him as payments became due.

He is also entitled to pay-related benefit at £5.83 weekly on the basis of his reckonable earnings during the income tax period 6 April 1980 to 5 April 1981 which governs his entitlement to pay-related benefit as the period of interruption of employment in his case commenced on 29 December 1982.

He is therefore being paid the full amount of benefit to which he is entitled.

558.

asked the Minister for Social Welfare when a decision will be made on the appeal of a person (details supplied) in County Monaghan for a higher disablement allowance.

The person concerned has been in receipt of disablement benefit since 14 July 1978 in respect of injuries received in an accident at work on 11 January 1978.

Following an examination by a medical referee of my Department on 9 November 1982 the extent of his disablement resulting from his accident was assessed at 15 per cent final for life from 26 November 1982.

The appropriate award for such an assessment is a disablement gratuity of £2,628.00. He was informed of this award on 17 November 1982 and of his right of appeal against it if dissatisfied.

There is no record of an appeal having been received in this case and so cheques (now returned by the Deputy) to the value of £2,628.00 were issued on 9 December 1982.

The Deputy's representations are being accepted as an appeal on behalf of the person concerned who will be advised of the steps he should take in order to pursue the appeal.

559.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Donegal.

The person concerned was paid disability benefit for the period 15 October 1981 to 13 October 1982, a period of 52 weeks, based on his contribution record in the 1979-80 year, the contribution year governing his claim. From 14 October 1982 onwards his title to disability benefit was governed by the number of contributions registered in the 1980-81 year and as he had less than the required minimum of 26 contributions, paid or credited, in that year he was not entitled to further payment. He was informed of the position on 22 September 1982.
