Written Answers. - Social Welfare Benefits.

389.

asked the Minister for Social Welfare when a decision on an appeal for unemployment assistance will be made for a person (details supplied) in County Galway.

The person concerned had been in receipt of unemployment assistance of £16.90 weekly being the appropriate maximum rate in his case of £30.85 less notionally assessed means of £13.95. Following the factual assessment of his means payment was disallowed from 14 September 1983 on the grounds that his means derived from land exceeded the statutory limit in his case of £2587.00 a year. His appeal against the disallowance has been referred to an appeals officer for early determination of his means. His entitlement to unemployment assistance will be reviewed in the light of the appeals officer's decision.

390.

asked the Minister for Social Welfare when arrears of unemployment benefit will be paid to a person (details supplied) in Dublin 12 who has been awaiting payment for eight months.

The person concerned is not entitled to unemployment benefit on the grounds that he did not fulfil the contribution conditions during the governing contribution period 6 April 1981 to 5 April 1982.

He claimed unemployment assistance however and was assessed with means at £3.80 weekly increasing to £13.60 from 18 May 1983 and all unemployment assistance due was paid. The rate of unemployment assistance payable to him was £55.40 weekly reducing to £45.60 from 18 May 1983 but increasing to £51.55 weekly from 29 June 1983. He appealed against the amount of means assessed against him but an appeals officer upheld the decision in his case.

He has not signed as unemployed since 11 July 1983.

391.

asked the Minister for Social Welfare the reason unemployment assistance has not been paid to a person (details supplied) in County Kilkenny as he has been signing for some time and has been visited by three social welfare officers.

The application of the person concerned for unemployment assistance on 16 August 1982 was disallowed on the grounds that his weekly means of £30.00 derived from self-employment at casual farm work and fishing exceeded the maximum rate of unemployment assistance payable in his case. He applied for a review of his means on 18 September 1983 but failed to disclose details of his means to the social welfare officer. He is now being afforded a further opportunity of disclosing his means. His entitlement to unemployment assistance will be reviewed in the light of the means assessed against him.

392.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Carlow.

The person concerned satisfied the conditions for unemployment assistance from 31 August 1983 to 5 September 1983 at the rate of £28.00 weekly and, as she is a postal applicant, an order issued to her for encashment at her local post office paying the amount due last week.

Her unemployment assistance claim from 6 September 1983 to 19 September 1983 was disallowed on the grounds that she was not available for work as she stated that she had to care for her sister's children.

Her unemployment assistance claim from 20 September 1983 to 31 October 1983 was disallowed on the grounds that she was not genuinely seeking employment.

Further inquiries are being made to ascertain what efforts she is making to find work from 1 November 1983 and when these inquiries are completed, her entitlement to unemployment assistance from 1 November 1983 will be determined.

In the meantime she is in receipt of supplementary welfare allowance pending the outcome of her unemployment assistance claim.

asked the Minister for Social Welfare the reason a person (details supplied) in County Laois has signed for unemployment assistance for 21 weeks at Portlaoise employment office; if he will investigate the case fully; and if he will make a statement on the matter.

The unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish details of his means he failed to show that his means do not exceed the statutory limit.

He recently indicated that he was prepared to co-operate in the investigation of his means and the case was referred to the social welfare officer for further inquiries. The social welfare officer has now completed his inquiries and the case is in postal transit to the Department's headquarters for an assessment of his means. His entitlement to unemployment assistance will be determined in the light of the outcome of the assessment.

394.

asked the Minister for Social Welfare if, in view of the circumstances surrounding the investigations and subsequent appeal on behalf of a person (details supplied) in County Louth, he will have his case reopened as a submission was made to the chief appeals officer some time ago and to date no reply has been received by him.

In the light of new evidence being made available, the chief appeals officer allowed the appeal of the person concerned against the disallowance of his unemployment assistance claim with effect from 17 November 1982 other than eight specified days.

The balance of all arrears due, less the amount of supplementary welfare allowance due to be recouped to his local health board was paid to him on 24 November 1983.

Further payments of unemployment assistance at £104.55 will be made as weekly payments become due.

395.

asked the Minister for Social Welfare the reason for the delay in paying pay-related benefit to a person (details supplied) in County Cork.

The person concerned has been in receipt of disability benefit from 12 August 1983, fourth day of incapacity, and all disability benefit due to 24 November 1983, date of the latest medical certificate received, has been issued.

The claimant is not entitled to pay-related benefit as the weekly rate of disability benefit exceeds 80 per cent of his average reckonable weekly earnings in 1981-82, the income tax year relevant to his claim.

396.

asked the Minister for Social Welfare the reason regular payments of occupational injury benefit have not been made to a person (details supplied) in County Cork.

The person concerned was paid occupational injury benefit from 5 March 1983 to 2 September 1983 at which stage his title to that benefit was exhausted as the statutory period of 26 weeks was completed. His claim was treated as one to disability benefit from 3 September 1983 onwards.

Payment of disability benefit has issued regularly on receipt of medical evidence of incapacity in the Department and all benefit due to 18 November 1983, date of the latest medical evidence received has been issued. There was a slight delay in issuing payment for the period 29 October 1983 to 4 November 1983 as the RSI number on the medical certificate received was not clearly stated and could not be associated with the claim.

397.

asked the Minister for Social Welfare the reason for the reduction in the rate of widow's pension being paid to a person (details supplied) in County Cork.

The non-contributory widow's pension which is in payment to the person concerned was reviewed last April to take account of increases in her British pension since the previous assessment of her means had been carried out. This review resulted in a reduction in her Irish pension from £29.15 per week to £19.15 per week with effect from 29 April 1983.

The rate of pension payable to the claimant was increased to £23.60 per week with effect from 1 July 1983. This amount which includes a living alone allowance of £3.00 per week is the rate payable to a widow over 66 years, with no qualified children, whose weekly means exceed £22 but do not exceed £24.

398.

asked the Minister for Social Welfare the reason a person (details supplied) in County Cork is not eligible for pay-related benefit as he is at present receiving unemployment benefit.

The entitlement of an applicant to pay-related benefit with flat-rate unemployment benefit is subject to the condition that the sum of flat-rate unemployment benefit, pay-related benefit and income tax rebate may not exceed 85 per cent of his average net weekly earnings. The 85 per cent limit applicable to the person concerned is £73.03.

The weekly flat-rate unemployment benefit payable from the commencement of his claim is £74.85 and as this exceeds the 85 per cent limit in his case no pay-related benefit was payable.

Weekly payments continue to be made to him as they become due.

399.

asked the Minister for Social Welfare the reason for the delay in paying unemployment benefit to a person (details supplied) in County Dublin; and if it will be paid immediately.

The non-contributory cerned to unemployment benefit on 14 September 1983 was authorised at the appropriate special rate in her case of £28.90 after inquiries to establish that she satisfied the condition of being available for employment were completed. All arrears due have been paid to her and weekly payments of £28.90 continue to be made as they become due.

400.

asked the Minister for Social Welfare when a non-contributory old age pension for the period 22 July to 12 August 1983 will be paid to a person (details supplied) in County Laois.

A payable order in respect of the value of three out-of-date pension orders submitted by the person concerned is in the course of being issued to her.

401.

asked the Minister for Social Welfare when disability benefit for the period 5 September to 19 November 1983 will be paid to a person (details supplied) in County Offaly.

Under the provisions of the Social Welfare Acts a person must have at least 156 contributions paid since entry into insurance in order to qualify for payment of disability benefit for a period exceeding 52 weeks.

According to the records of the Department, the person concerned has a total of only 137 such contributions since entry into insurance and her entitlement to payment of disability benefit was, therefore, exhausted on 7 November 1983.

A delay arose in making payment from 6 September to 7 November 1983 as medical evidence for the period was not received in the Department. This evidence was subsequently furnished and all arrears of benefit due have now been paid.

402.

asked the Minister for Social Welfare if he will outline the reasons a person (details supplied) in County Galway was not paid the correct amount of unemployment benefit and assistance; the reason he signed in February 1983 and was not paid until November 1983; the reason he was then only paid for the period July to November 1983; the reason he only received £3.00 per week despite the fact that he has no property or income; if he will direct his Department to pay the correct amount to him immediately; and if he will make a statement on the matter.

The claim of the person concerned to unemployment benefit on 1 February 1983 was disallowed on the grounds that he did not satisfy the relevant contribution conditions. He applied for unemployment assistance on 12 July 1983 and was assessed with weekly means of £25.00 derived from the value of board and lodging on his parents' farm. Due to an oversight delay arose in authorising unemployment assistance of £3.00 weekly being the appropriate maximum weekly rate in his case of £28.00 less the means of £25.00. All arrears due were paid on 10 November 1983.

Following the completion of inquiries to establish his entitlement to unemployment assistance from 1 February 1983 to 11 July 1983 payment of arrears due for that period will be made to him this week. He has appealed against the amount of means assessed against him and his case has been referred to an appeals officer for determination of his means. His entitlement to unemployment assistance will be reviewed in the light of the appeals officer's decision.

In the meantime weekly payments of £3.00 will continue to be made as they become due.

403.

asked the Minister for Social Welfare when an old age pension at the correct rate will be paid to a person (details supplied) in County Galway.

The person concerned is in receipt of old age pension at the rate of £20.60 per week. This is the rate to which she is entitled having regard to the latest assessment of her means consisting of half the weekly value of income from the letting of two holdings and capital.

An application for an increase in her pension has recently been received and is being referred to the social welfare officer for investigation. When investigations have been completed the matter will be referred to the local pension committee for decision and she will be notified of the outcome in due course.

404.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Carlow.

The person concerned is not entitled to unemployment benefit on the grounds that he does not fulfil the contribution condition during the governing contribution period 6 April 1981 to 5 April 1982. He was asked to furnish a form P.60 or a statement from his employer showing his employment record during the period but he has not done so to date. The matter of non-compliance by his former employer has been referred to a social welfare officer for investigation.

He was advised of his right to claim unemployment assistance but he declined to do so. He ceased to sign as unemployed after 7 September 1983.

405.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Cork.

The person concerned was assessed with means at £33.00 weekly derived from the value of board and lodging on her father's holding. The means assessed against her exceeded the maximum rate of unemployment assistance payable to her and accordingly her unemployment assistance claim was disallowed.

She applied to have her case reinvestigated and the case was referred to a social welfare officer for inquiries. However, following the completion of those inquiries her means were again assessed at £33.00 weekly.

406.

asked the Minister for Social Welfare if a free television licence will be granted to a person (details supplied) in County Cork.

An application for a free television licence has not been received from the person concerned and, on the information available, it is not possible to say if she would be qualified. Full information on the scheme has been sent to her and if she feels that the qualifying conditions are satisfied in her case she should apply for a free licence at her local post office.

asked the Minister for Social Welfare if there are any records in his Department in respect of a person (details supplied) in Dublin 8 as she worked in the Eye and Ear Hospital in the 1940s and early 1950s.

According to the records of the Department she reached old age pension age in July 1976. To qualify for the minimum rate of old age contributory pension she would require a yearly average of 20 contributions paid or credited over the 23-year period July 1953 to June 1976. Her total of 345 qualifying contributions in this period is equal to a yearly average of 15 and accordingly she is not entitled to this pension.

408.

asked the Minister for Social Welfare the reason unemployment assistance at the maximum rate is not being paid to a person (details supplied) in County Kilkenny as he is married with five dependent children and has no income.

The person concerned was assessed with means at £19.20 weekly derived from self-employment and the profit from his land. He is at present in receipt of unemployment assistance at £67.80 weekly the maximum rate payable to him £87.00 less £19.20 means.

He appealed against the amount of means assessed against him and following the completion of further inquiries by a social welfare officer his case was referred to an appeals officer for determination. The rate of unemployment assistance payable to him will be reviewed in the light of the decision of the appeals officer in his case.

409.

asked the Minister for Social Welfare if he will arrange to have a person (details supplied) in County Kilkenny transferred from disability to invalidity pension as the application has been made for some time.

The person concerned is being paid disability benefit at regular weekly intervals and payment has been made to date.

A form on which to claim invalidity pension has been forwarded to him and on its return, duly completed, the claim will be dealt with without delay.

410.

asked the Minister for Social Welfare the reason a person (details supplied) in County Kilkenny was disallowed unemployment assistance.

The unemployment assistance claim of the person concerned was disallowed on the grounds that she was a married woman and a dependant of her husband.

She has appealed against the decision and her case has been referred to an appeals officer for determination. Her application for unemployment assistance will be reviewed in the light of the decision of the appeals officer.

asked the Minister for Social Welfare the reason unemployment assistance has not been paid to a person (details supplied) in County Kilkenny; and if he will arrange to have his case investigated with a view to having assistance granted.

The person concerned was assessed with means in excess of the statutory limit and his unemployment assistance claim was accordingly disallowed. He appealed against the amount of means assessed against him but an appeals officer upheld the disallowance in his case. He last signed as unemployed at his local office on 15 June 1982.

It is however open to him to apply for a reinvestigation of his means after which the assessment of his means will be reviewed. An application form for this purpose may be obtained at his local office.

412.

asked the Minister for Social Welfare the approximate number of benefit days or weeks in 1983 which are attributable to lay-offs and short-time in local authorities; and the approximate pay-out of social welfare benefit from the Social Insurance Fund for these purposes.

Statistics are not maintained in a way which would enable the information requested by the Deputy to be furnished.

413.

asked the Minister for Social Welfare the amount of unemployment and pay-related benefits payable on 1 February, 1 July and 1 October 1983, disregarding income tax refunds, to an insured person in receipt of the basic maximum road workers' rate of pay without overtime employed full-time during the qualifying period in county councils, as approved by the Department of the Environment under the Public Service Pay Agreement (a) if he is single and (b) if he is a married person in respect of (i) a full week under continuous lay-off, (ii) a three day week (short time) and (iii) alternative weeks on lay-off.

Notes: 1. The relevant income tax year for pay-related benefit purposes is 1981-82. The calculations are based on the basic pay of a road worker in Dublin County Council, excluding any overtime, arrears of pay or the effects of any absences from work during that year. The amount involved is £5,102.

414.

asked the Minister for Social Welfare if disability benefit will be paid to a person (details supplied) in County Westmeath pending a decision on his application for occupational injury benefit from 12 October 1983.

The person concerned claimed injury benefit from 14 October 1983 in respect of an incapacity resulting from an occupational accident on 21 March 1983.

Injury benefit is confined to a period of 26 weeks from the date of the accident. The period of claim was outside the maximum injury benefit period and accordingly injury benefit was not payable. Instead he was allowed disability benefit from 18 October, the fourth day of incapacity at the personal rate of £34.80 a week pending further investigation regarding his entitlement to dependants increases of benefit.

He had previously been paid injury benefit in respect of an incapacity resulting from the same accident at work for the period from 21 March 1983 to 27 June 1983. It has also been decided to allow payment of injury benefit in respect of medical evidence submitted for the period from 25 July 1983 to 15 August 1983 and a cheque for £151.69 was issued to him on 25 November 1983.

Payment of disability amounting to £121.80 for the period from 14 October 1983 to 10 November 1983, date of the latest medical certificate received, has been withheld towards recovery of an overpayment of £290.42 incorrectly paid on his first injury benefit claim in respect of an adult dependant. Further payments of benefit will be issued as medical evidence of continuing incapacity is received.

In determining the amount of the payment account will have to be taken of his entitlement in respect of dependent children, about which inquiries are being made, and the overpayment still outstanding.

415.

asked the Minister for Social Welfare when the correct rates of disability and pay-related benefits will be paid to a person (details supplied) in County Meath in respect of the periods 23 to 31 August 1983 and 11 to 19 October 1983.

The person concerned claimed disability benefit from 23 August 1983 to 31 August 1983 and 11 October 1983 to 19 October 1983 and was paid at an incorrect rate as he failed to claim an increase in benefit in respect of his wife.

It has now been established that he is a married man with two qualified children and arrears of benefit due for the periods concerned have been issued.

Pay-related benefit is payable from the nineteenth day of incapacity on a disability benefit claim. The two claims concerned were of less than 19 days duration and pay-related benefit was not, therefore, payable to the claimant.

416.

asked the Minister for Social Welfare the reason social welfare assistance which was paid to a person (details supplied) in County Galway who is a farmer was withdrawn; the reason he received no communication from his Department since he appealed this decision last August; and if he will now give the result of his appeal.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means, derived from the profit from his land, from capital, from a pension and the benefit of his wife's earnings, exceeded the statutory limit. He appealed against the disallowance on 25 August 1983 and the case was referred to headquarters of the Department for transmission to an appeals officer. However, due to misfiling the submission of the papers to an appeals officer was inadvertently delayed and the case was only recently referred to the appeals officer. Arrangements have been made to have the case dealt with by an appeals officer as quickly as possible.

417.

asked the Minister for Social Welfare when arrears of an old age pension will be paid to a person (details supplied) in County Donegal.

Old age pension ceased to be payable when the person concerned left the State. Payment of pension was restored from 11 February 1983 following her return. Inquiries had to be made before her entitlement prior to that date could be determined. These inquiries have now been completed and it has been decided to allow payment of pension for the full period of her absence from the State. A payable order for the arrears due will be issued shortly.

418.

asked the Minister for Social Welfare if unemployment assistance will be paid to a person (details supplied) in County Wexford.

The entitlement of the person concerned to unemployment assistance could not be determined until her means were assessed and her date of birth confirmed.

All the inquiries were recently completed and her claim was allowed at the maximum rate of £28.00 weekly. Arrangements have been made to pay arrears due this week less supplementary welfare allowance due for refund, to her local health board.

Further payments will be made as weekly payments become due.

419.

asked the Minister for Social Welfare if a free electricity allowance will be restored to a person (details supplied) in County Wexford.

A free electricity allowance cannot be applied to the account of the person concerned as he no longer satisfies the conditions for entitlement to this benefit. The allowance which he had been receiving was terminated because his eldest son, who is residing with him, ceased to be a person who comes within the excepted categories for satisfying the "living alone" condition of the scheme when he reached the age of 18 years.

420.

asked the Minister for Social Welfare if a person (details supplied) in County Wexford will be entitled to disability benefit when his entitlement to occupational injury benefit lapses.

The person concerned has been in receipt of occupational injury benefit from 22 June 1983 and will be entitled to payment provided he continues to be incapacitated to 20 December 1983, the expiry date of 26 weeks statutory period of entitlement. The claimant is qualified for the receipt of disability from 21 December 1983 and benefit will issue on receipt of medical evidence of incapacity.

A medical referee examination has been arranged for 8 December 1983 for the purpose of assessing the extent of his disablement resulting from his occupational accident. His entitlement to disablement benefit will be reviewed on receipt of the medical referee's report following this examination.

421.

asked the Minister for Social Welfare if one week's disability benefit, which was not received, will be paid to a person (details supplied) in County Wexford.

The person concerned has been paid all disability benefit due to date. A replacement cheque for the period 12 September 1983 to 17 September 1983 was issued to her on 25 November 1983 on receipt of a completed indemnity form in the Department.

asked the Minister for Social Welfare if unemployment assistance payments will be granted to a person (details supplied) in County Wexford.

The person concerned was in receipt of unemployment assistance until 6 September 1983 at the weekly rate of £28.00, being the appropriate maximum rate for a single person with nil means living in a non-urban area. The payment ceased from 7 September, 1983 when his qualification certificate was revoked on the grounds that on reinvestigation of his application he had failed to disclose his means. He has recently been afforded a further opportunity of disclosing his means to the social welfare officer and his entitlement to unemployment assistance will be reviewed in the light of the means assessed against him.

423.

asked the Minister for Social Welfare the reason for the reduction in the rate of non-contributory old age pension being paid to persons (details supplied) in County Monaghan.

Old age pension ceased to be payable when the persons concerned left the State in May 1982. On their return, payment was restored from 3 January 1983, that is, three months prior to the date of their return.

Pension at the maximum rate has been in payment from 8 April 1983, the Friday following the date of their return and is at present in payment. Pension at the rate of £4.45 a week has been paid in respect of the three months prior to their return. The assessment of their means, comprising the weekly value of supplementary benefit received during their absence from the State, only entitles them to a pension of £4.45 a week in respect of the three month period concerned.

Payment of pension for the three months prior to their return has been made on a provisional basis pending the local pension committee's decision on the rate of pension payable for that period.

424.

asked the Minister for Social Welfare the reason a person (details supplied) in County Meath is not entitled to unemployment benefit.

The person concerned exhausted his entitlement to unemployment benefit when he completed 390 days of benefit on 1 August 1983. His case was referred to a social welfare officer for investigation of his means and he was requested to furnish details of the income of his household to enable the value of board and lodgings to be assessed but he failed to do so.

He recently applied for a reinvestigation of his means and his case has again been referred to a social welfare officer for inquiries. When these inquiries are completed his means will be assessed and his entitlement to unemployment assistance will be determined accordingly.

In the meantime he is in receipt of supplementary welfare allowance pending the outcome of his unemployment assistance application.

425.

(Limerick West) asked the Minister for Social Welfare if he will expedite the payment of disability benefit to a person (details supplied) in County Limerick.

The person concerned has not claimed disability benefit since 24 June 1982. However he claimed unemployment benefit on 1 July 1982 and after receiving his full entitlement of 390 days applied for unemployment assistance on 29 September 1983. He is at present receiving unemployment assistance of £80.30 weekly being the appropriate maximum rate in his case.

Weekly payments of £80.30 continue to be made as they become due.

426.

(Limerick West) asked the Minister for Social Welfare when unemployment assistance will be fully restored to a person (details supplied) in County Limerick.

The person concerned has been continuously in receipt of unemployment assistance since 7 August 1973 and was paid at the rate of £47.75 weekly being the maximum rate payable to him £50.75 less £3.00 means. His claim was reviewed and following an investigation by a social welfare officer his means were assessed at £32.15 weekly derived from capital, a private pension and the benefit of his wife's old age pension. The rate of unemployment assistance payable to him was accordingly reduced to £18.60 being the maximum rate payable to him £50.75 less £32.15 with effect from 12 October 1983.

If he is dissatisfied with the amount of means assessed against him it is open to him to appeal and to have his case determined by an appeals officer. A form for this purpose may be obtained at his local office.

427.

(Limerick West) asked the Minister for Social Welfare if disability benefit will be continued to a person (details supplied) in County Limerick.

The person concerned has been paid disability benefit from 30 November 1982 following receipt of occupational injury benefit for the statutory period of 26 weeks. All disability benefit due to 21 November 1983, date of latest medical certificate received, has been issued.

From 3 December 1983 his entitlement to benefit depends on his 1981-82 insurance record and his claim was reviewed to decide if he was entitled to further payment.

It has now been ascertained that he is qualified for continued payment based on his 1981-82 insurance record. Further payments of benefit will be issued as medical certificates are received.

428.

asked the Minister for Social Welfare the reason for the non-payment of a children's allowance to a person (details supplied) in County Cork.

The person concerned claimed children's allowance on 24 August 1983 in respect of her son born on the 8 April 1983 and was awarded an allowance in respect of him from September 1983. This was the earliest date from which payment could be made having regard to the date on which the claim was submitted. From 1 September 1983 the claimant has been in receipt of a monthly allowance of £45.00 in respect of her four qualified children and she is accordingly in receipt of her full entitlement.

asked the Minister for Social Welfare when a living alone allowance will be paid to a person (details supplied) in County Wexford.

There is no trace of an application for a living alone allowance from the person concerned having been received in the Department. In the circumstances an application form was issued to him and on the return of the completed form his entitlement will be considered and he will be notified of the outcome.

asked the Minister for Social Welfare the reason for the delay in taking a decision on an application for unemployment assistance by a person (details supplied) in County Monaghan.

The unemployment assistance claim of the person concerned was suspended from 18 August 1982 on receipt of evidence that he had been concurrently working and claiming on 29 days during 1981 and 1982. His claim was subsequently disallowed in respect of these days and an overpayment of £351.53 was assessed against him. He appealed against this decision but the appeals officer rejected the appeal. Further enquiries to establish his entitlement to unemployment assistance from 18 August 1982 were recently completed and all arrears due less the overpayment of £351.53 have been paid to him. Weekly payments of £21.20 will continue to be made to him as they fall due.

(Limerick West) asked the Minister for Social Welfare when unemployment benefit will be restored to a person (details supplied) in County Limerick.

The person concerned claimed unemployment benefit on 10 January 1983. She did not qualify for unemployment benefit as she did not have 26 paid or credited contributions in the governing contribution period 6 April 1981 to 5 April 1982. She last signed as unemployed on 12 July 1983 and has not been in touch with her local office since then. She was written to and asked to furnish details of any employment she may have had but she failed to reply. A further request has issued to her and her entitlement to unemployment benefit will be reviewed in the light of the outcome of her reply.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Carlow.

The unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish details of his means he failed to show that his means did not exceed the statutory limit. Following a further investigation in which he was afforded an opportunity of disclosing his means, an appeals officer upheld the disallowance of his case.

He again applied for a review of his means and his case was referred to a social welfare officer for a further investigation. The social welfare officer recently completed his inquiries and the case is at present in transit to a deciding officer at the headquarters of the Department. The assessment of his means will be reviewed on the basis of the report and his entitlement to unemployment assistance will be determined accordingly.
