asked the Minister for Justice if there was any internal Garda inquiry into the case of Amanda McShane; and the outcome of the inquiry.

Limerick East): I would refer the Deputy to the answer which I gave to a previous question on this matter on 14 December 1983 (Official Report, Volume 346, columns 2078 and 2079). In that reply I indicated that a partial Garda investigation had been carried out and that a fuller investigation would be carried out if the woman concerned or her solicitor were willing to assist the Garda.

The woman and her solicitor did in fact subsequently make themselves available for interview and I am informed by the Garda authorities that following a full investigation a file, which of course included the statements made by the woman concerned and by her solicitor, was submitted to the Director of Public Prosecutions for directions as to whether criminal proceedings against any member of the force were warranted. I am further informed that, on receipt of directions from the DPP that criminal proceedings were not warranted, the question whether proceedings were warranted under the Garda Síochána (Discipline) Regulations, 1971, was considered by the Commissioner and that the decision was similar to that which had been taken by the DPP in relation to criminal proceedings, namely that disciplinary proceedings were not warranted against any member.
