Written Answers. - County Carlow Redundancy Payment.

asked the Minister for Labour when a redundancy payment will be made to a person (details supplied) in County Carlow.

My Department has not been notified by the employer concerned under the Redundancy Payments Acts of the proposed redundancy of the person concerned and no application has been received for payment of a statutory redundancy lump sum.

If the employment of the person concerned has been terminated and she considers that she is entitled to payment of a statutory redundancy lump sum she should apply for payment to her employer using form RP 77. If the employer gives her a redundancy certificate (form RP 2) but refuses or is unable to pay her a statutory redundancy lump sum she should complete form RP 14 and send it together with the redundancy certificate to my Department where her application will be considered for payment from the Redundancy and Employers; Insolvency Fund.

However, if her employer refuses to give her a redundancy certificate and pay her, the only way that she can establish an entitlement to a payment of a statutory redundancy lump sum is by appealing to the Employment Appeals Tribunal for a determination of her entitlement. Form 51A may be used in the event of such an appeal. I will send the Deputy copies of these forms.
