asked the Minister for Labour the reason a person (details supplied) in County Cavan received no redundancy payment.

I understand that the person concerned, who was temporarily laid off work some months ago, applied to his employer for payment of a statutory redundancy lump sum but that the employer served counter-notice under the Redundancy Payments Acts that work was available for the employee and that he should return to his employment. If the person concerned considers that he is entitled to a statutory redundancy lump sum payment and this is disputed by his employer, the only way open to him to establish his entitlement is by appealing to the Employment Appeals Tribunal for a determination of his case. In case he wishes to pursue this course, I am sending the Deputy the appropriate form for an appeal to the tribunal.

asked the Minister for Labour when redundancy money will be paid to a person (details supplied) in County Cork.

My Department has no record of a claim for payment of a redundancy lump sum in respect of the person concerned. I should explain, in any event, that an employer is responsible in the first instance for the payment of a statutory redundancy lump sum and that if an employee has not received such payment or a redundancy certificate (form RP2), he should claim payment of the lump sum by serving form RP77 on his employer. If the employer gives the employee a redundancy certificate but refuses to pay him a statutory redundancy lump sum, the employee should complete form RP14 and send it, together with the redundancy certificate, to my Department so as to claim payment from the Redundancy and Employers' Insolvency Fund. However, if the employer fails or refuses to pay a redundancy lump sum or to issue a redundancy certificate, the only way open to an employee to establish entitlement to payment of a statutory redundancy lump sum is by appealing to the Employment Appeals Tribunal for a determination of his case. In order to enable the person concerned here to pursue his claim, my Department has already sent the Deputy the appropriate forms.
