Vol. 362 No. 1

Written Answers. - Redundancy Payments.

216.

asked the Minister for Labour when a redundancy payment will be made to a person (details supplied) in County Wexford.

My Department has not received an application for payment of a statutory redundancy lump sum to the person concerned. I understand, in any event, that she had less than two years service with the company by which she was employed and would not, therefore, be entitled to payment of a lump sum under the Redundancy Payments Acts. I understand, however, that the person concerned has been awarded payment in lieu of minimum notice by the Employment Appeals Tribunal. In order to claim that payment, she should complete form IP2, which has been sent to her by the tribunal, and submit it to the receiver of the company who will then apply to my Department for funds to pay the minimum notice award. As soon as the application is received through the receiver, it will be dealt with without delay by the Department.

asked the Minister for Labour when a redundancy payment will be made to a person (details supplied) in County Wexford.

The person concerned will be paid his statutory redundancy lump sum entitlement from the Redundancy and Employers' Insolvency Fund within the next few days.

218.

asked the Minister for Labour when a person (details supplied) in County Kerry will receive his statutory redundancy money which he claimed on 16 August 1985.

The person concerned was paid his full statutory lump sum entitlement from the Redundancy and Employers' Insolvency Fund on 23 October 1985.

219.

asked the Minister for Labour if he will arrange to pay the application for entitlements under the Protection of Employees (Employers' Insolvency) Act, 1984, to a person (details supplied) in County Kerry.

The person concerned is claiming payment from the Redundancy and Employers' Insolvency Fund of outstanding wages, holiday pay and a minimum notice award by the Employment Appeals Tribunal on the basis of the insolvency of the company. My Department is investigating the circumstances of the closure of the company in order to establish whether it can be deemed to be insolvent for the purposes of the Protection of Employees (Employers' Insolvency) Act, 1984. These investigations will require some time to complete and may involve the making of a statutory instrument. If the investigations show that the company is insolvent for the purposes of the Act, the claims of the person concerned will be processed without delay by the Department.
