asked the Minister for Defence if he will re-examine the refusal of a pension to a person (details supplied) in County Cork; if he is aware that this person's disablement is now regarded as due to disease but that the degree of disablement, 40 per cent, is below the minimum for the granting of a pension under the Army Pensions Act for disablement due to disease; and if he regards this as unfair treatment.

The person referred to by the Deputy has been re-examined by the Army Pensions Board, who are the statutory body appointed to report on claims for disability pensions by former members of the Permanent Defence Force. The board found that the applicant did not satisfy the conditions for the award of a pension. As the findings of the board are final and conclusive I regret that I have no authority to award a pension in this case.
