asked the Minister for Social Welfare when a decision will be made on an application for unemployment assistance by a person (details supplied) in County Galway.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means, derived from self-employment, exceeded the statutory limit. He appealed against the disallowance on 3 April 1986. Arising from contentions made in support of his appeal, his papers were returned to the social welfare officer for further inquiries. When these inquiries, which will be completed as soon as possible, are completed, the case will be submitted to an appeals officer for determination at the earliest available opportunity. The person concerned will be notified of the outcome of the appeal and of the decision on his entitlement to unemployment assistance as quickly as possible.

asked the Minister for Social Welfare when a decision will be made on an application for unemployment assistance by a person (details supplied) in County Galway.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means, derived from self-employment and income from the letting of land, exceeded the statutory limit. He appealed against the disallowance on 25 March 1986 and arising from contentions made in support of his appeal, his papers were returned to the social welfare officer for further inquiries. When these inquiries, which will be completed as soon as possible, are completed, the case will be submitted to an appeals officer for determination of means at the earliest possible available opportunity. The person concerned will be notified of the outcome of the appeal and of the decision on his entitlement to unemployment assistance as quickly as possible.

asked the Minister for Social Welfare whether a person (details supplied) in County Galway is in receipt of a maximum rate of unemployment assistance.

Following investigation of his unemployment assistance claim, the means of the person concerned were assessed at £67.70 weekly, derived from profit from his holding. He is, accordingly, entitled to unemployment assistance at £4.55 weekly, being the appropriate maximum rate payable in his case of £72.25, less means of £67.70. He appealed on 11 April 1986 against the means assessment and arising from contentions made by him in support of his appeal, the case was returned to the social welfare officer for further inquiries. When the inquiries, which will be completed as soon as possible, are completed, the case will be submitted to an appeals officer for determination of means. The person concerned will be informed of the outcome of the appeal and of the rate of unemployment assistance payable, at the earliest possible date. Further weekly payments of unemployment assistance will continue to be made as they become due.

asked the Minister for Social Welfare the reason arrears of unemployment benefit were not repaid to the date of claim for a person (details supplied) in County Wexford; and if further arrears will now issue.

Entitlement to unemployment benefit is subject to the condition that a claimant must be available for employment. The person concerned claimed unemployment benefit on 28 August 1985 but his claim was disallowed by a deciding officer on the grounds that he was not available for employment. He appealed against the disallowance and attended an oral hearing of his case on 2 April 1986.

The appeals officer also decided that he was not available for employment during the period 28 August 1985 to 13 February 1986 but allowed his appeal from 14 February 1986. All arrears due from 14 February 1986 were included in the payment for week ending 9 April 1986. Weekly payments of £65.10, which is the maximum flat rate of benefit appropriate in this case, are continuing to be made as they become due.

In the exercise of control of claims at local offices, claims for unemployment benefit and assistance are reviewed periodically to ascertain whether the conditions for receipt of payment continue to be satisfied. The claim of the person concerned will be reviewed in accordance with this procedure in May 1986.

asked the Minister for Social Welfare when full rate and up-to-date payments of disability benefit will be made to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 11 March 1986. Payment at the weekly rate of £34.70 the maximum rate appropriate to a married woman has been issued to 9 April 1986 the date of the latest medical certificate received. She was also paid pay-related benefit at the weekly rate of £20.81 from 1 April 1986, 19th day of incapacity. All benefit payable in respect of her claim has been issued to her.

asked the Minister for Social Welfare the reason a person (details supplied) in County Wexford has had disability benefit payments discontinued; if payments can be reinstated; if not, if certificates will be accepted as credits; and, if so, when the person will resume benefit.

The person concerned claimed disability benefit from 10 April 1985 and payment was issued to 10 April 1986 on the basis of her contributions during the 1983-84 contribution year. From 12 April 1986 her claim is governed by the 1984-85 contribution year and the person concerned was not entitled to payment of benefit after that date as she had less than the required minimum of 26 contributions paid or credited in that year. She had only 15 contributions recorded.

It has now been established that she has 52 A2 contributions paid during 1984-85 and accordingly she is qualified for payment of disability benefit. Further payments of disability benefit will be issued to her on receipt of weekly medical certificates while she remains incapable of work.

asked the Minister for Social Welfare when a person (details supplied) in County Galway will be paid unemployment assistance.

The unemployment assistance claim of the person concerned was disallowed on the grounds that his means, derived from benefit from his wife's earnings, exceeded the statutory limit. He was notified of the disallowance on 3 April 1986 and was issued with an appeal from on 8 April 1986. When he returns the completed from, his case will be submitted to an appeals officer for determination of means. The person concerned will then be notified of the outcome of the appeal and of the decision on his entitlement to unemployment assistance as quickly as possible.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Galway.

The unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish particulars of her means she failed to show that her means did not exceed the statutory limit.

She recently appealed against the disallowance and indicated a willingness to disclose her means. The papers in her case were, accordingly, returned to the social welfare officer for investigation. When the inquiries, which will be completed as soon as possible, are completed, her entitlement to unemployment assistance will be determined in the light of the means assessed against her.

asked the Minister for Social Welfare if she will arrange to pay unemployment assistance to a person (details supplied) in County Cork.

Following reinvestigation of the unemployment assistance claim of the person concerned he was assessed, with effect from 12 February 1986, with means of £3 weekly, derived from self-employment. He is, accordingly, entitled to unemployment assistance of £30.80 weekly, being the appropriate maximum rate payable in his case of £33.80 less means of £3.

Arrangements have been made with his local office to pay all arrears, arising from the revised means assessment, this week and weekly payments of £30.80 will then be made as they become due.

asked the Minister for Social Welfare is she will arrange to pay unemployment assistance to a person (details supplied) in County Cork.

Following investigation of the unemployment assistance claim of the person concerned, he was assessed with means of £37.45 weekly, derived from the profit from his holding.

He is, accordingly, entitled to unemployment assistance of £39.50 weekly, being the appropriate maximum rate payable in his case of £76.95 less means of £37.45. Arrangements have been made with his local office to pay all arrears due next week, and weekly payments of £39.50 will be made as they become due.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Carlow for the stated period.

The person concerned claimed disability from 30 July 1984 and payment was issued to 29 August 1985.

Payment was disallowed from 30 August 1985 following examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance and was examined by a different medical referee who also expressed the opinion that he was capable of work. His case was then referred to an appeals officer who upheld the decision to disallow payment of disability benefit from 30 August 1985 to 25 November 1985, the date of the latest medical certificate before him. The decision of the appeals officer is final and can only be altered in the light of new facts or fresh evidence.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Carlow.

The person concerned claimed disability benefit from 3 March 1986 and was paid at the weekly rate of £39.50, the maximum rate appropriate to a single man.

The records of the Department show that payment was issued at regular weekly intervals on receipt of medical evidence and all benefit payable has been issued to 31 March 1986.

A from was issued to the person concerned on 12 March 1986 to enable him to claim for his dependants. The final certificate submitted by him was returned to him on 21 April 1986 as it was not properly completed. When these forms are returned to the Department any arrears of benefit that may be due will be issued.
