asked the Minister for Finance if he is aware that the capital acquisitions tax branch of the Revenue Commissioners have ruled that they have no power under section 44 (4) of the Finance Act to grant relief on the grounds of quick succession and that they have failed since March 1985, to list the matter for hearing by the Appeals Commissioners; and the action he proposes to take in the matter.

I have been advised by the Revenue Commissioners that no provision for quick succession relief exists in the capital acquisitions tax legislation and that, in their opinion, there is no complication of circumstances affecting the inheritances involved in this case which would justify them, under section 44 (4) of the Capital Acquisitions Tax Act, 1976, in compounding the inheritance tax payable.

The Revenue Commissioners have requested returns from the taxpayer in order to assess finally the inheritance tax payable. He has also been advised of his right to appeal to the appeal commissioners against these assessments when made.
