asked the Minister for the Environment the plans, if any, he has to up-date the planning laws in order that local authorities such as Dublin County Council and Dublin Corporation will not be liable to pay damages to developers and contractors who are refused planning permission by such local authorities.

It is assumed that the Deputy is concerned about the payment of compensation under the Planning Acts. The position is that I am currently reviewing the planning compensation code in the light of recent court cases and judgments on the matter and taking account also of the Programme for National Recovery and the Fianna Fáil policy document Construction and the Environment. My objective is to bring forward suitable amendments to the law within the limits set by the Constitution as soon as possible, with due regard to the particularly difficult and complex nature of this area of legislation.
