asked the Minister for Social Welfare if the appeal against a decision to disallow disability benefit to a person (details supplied) in Dublin 12 will now be allowed in view of the new medical evidence submitted.

The person concerned was paid disability benefit to 13 June 1987 after which date payment was disallowed following examination by a medical referee who expressed the opinion that she was capable of work. She appealed against the disallowance of benefit and was examined by a different medical referee on 23 July 1987 who also expressed the opinion that she was capable of work.

Her appeal has been referred to an appeals officer. No date has been set for an oral hearing but the medical evidence which was submitted on her behalf will be considered by the appeals officer.

asked the Minister for Social Welfare if he will have dentures replaced for a person (details supplied) in Dublin 12; and if he will make a statement on the matter.

If the person concerned visits her dentist and arranges to have the necessary claim form completed, payment will be authorised in her case in accordance with the appropriate scale of dental fees. Under the terms of the dental benefit scheme, dentures are available at a fixed cost of which the Department pays one third and the claimant is required to pay the balance directly to the dentist.

asked the Minister for Social Welfare if the claim for disability of a person (details supplied) in Dublin 12 will be reviewed; and if he will make a statement on the matter.

The person concerned was paid disability benefit from December 1986 to 27 May 1987 when payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work.

He appealed against the disallowance and was examined by a different medical referee who also expressed the opinion that he was capable of work. His case was then referred to an appeals officer who upheld the decision to disallow payment of disability benefit to 4 September 1987, the date of the latest medical certificate before him.

The decision of the appeals officer is final and can only be altered in the light of new facts or fresh evidence.
