Written Answers - Social Welfare Benefits.

asked the Minister for Social Welfare the reason a person (details supplied) in County Wexford is no longer in receipt of disability benefit.

The person concerned was paid disability benefit up to 2 January 1988.

From 4 January 1988 his entitlement to disability benefit is based on his insurance record for the 1986-87 contribution year. Initially it was considered that he was not qualified for payment from that date as he appeared to have less than the minimum of 26 contributions paid or credited in the 1986-87 contribution year.

Following inquiries it was established that he had sufficient contributions credited in that year to qualify for payment at the maximum rate payable to a married man with an adult and three child dependants.

All benefit payable to 4 February 1988, the date of the latest medical certificate received, less the amount of supplementary welfare allowance advanced by the health board, has now been issued to him.

asked the Minister for Social Welfare the present position regarding the application of a person (details supplied) in County Waterford who appealed against the decision to refuse disability benefit; and the reason for the delay in having the appeal case dealt with.

The person concerned was paid disability benefit to 27 July 1987 after which date payment was disallowed following examination by a medical referee who expressed the opinion that he was capable of work. He appealed against the disallowance of benefit and was examined by a different medical referee on 7 September 1987 who also expressed the opinion that he was capable of work.

His appeal has been referred to an appeals officer who proposes to hold an oral hearing of his claim on 10 February 1988.
