asked the Minister for Social Welfare whether a person (details supplied) in County Wexford is eligible for maternity allowance for women in the employment scheme.

The scheme for women in employment applies only to women who are on maternity leave from work under the Maternity Protection of Employees Act, 1981.

It is a condition for receipt of benefit under the scheme that the women should be in employment. The details supplied by the Deputy appear to indicate that the person concerned would not be in employment when the normal maternity leave period might be expected to commence. However, she should, if in any doubt as to her entitlement, make a claim for maternity allowance at the appropriate time.
