asked the Minister for Social Welfare the reason a person (details supplied) in County Kildare was refused an application for unemployment benefit following the cessation of her disability benefit.

Entitlement to unemployment benefit is subject to the condition that a person must be available for and genuinely seeking work. The person concerned was in receipt of disability benefit from 20 June 1983 to 25 October 1987, when she was found capable of work by a medical referee. She then claimed unemployment benefit and following inquiries to determine her entitlement to benefit her claim was disallowed by a deciding officer on the grounds that she was not available for and not genuinely seeking work.

She appealed against the disallowance and she attended an oral hearing of her case on 15 February 1988. The appeals officer also decided that she was not available for and not genuinely seeking work. She continued to sign the unemployed register after the date of the appeals officer's decision and further inquiries are now being made to establish whether she now fulfils the condition of being available for and genuinely seeking work. When these inquiries are completed her entitlement to unemployment benefit from 16 February 1988, that is, the date after the appeals officer's decision, will be determined.

asked the Minister for Social Welfare the reason a person (details supplied) in County Kerry is currently on a reduced rate of pension.

The person concerned is not in receipt of pension. An appeals officer has determined that he is not entitled to old age pension on the ground that his means, consisting of the weekly value of a holding and capital, exceed the statutory limit of £50 a week for entitlement in his case.

The appeals officer's decision is final unless new facts or fresh evidence are brought forward.
