Vol. 379 No. 6

Written Answers. - Payment of Damages.

86.

asked the Minister for Justice whether damages received in civil actions by plaintiffs take into account any moneys received by way of disability benefit from the State; and whether such moneys are repaid to the Department of Social Welfare.

This is a matter for the discretion of the courts except in cases where statutory provisions apply. I am informed that it is not the practice to seek refunds of benefit.
