asked the Minister for Social Welfare the reason amounts of money are deducted from social welfare payments made to a person (details supplied) in Dublin 22 whenever he applies for disability benefit as this person did not receive cheques for the period August 1981 to August 1982 to which the deductions relate; in the circumstances, if he will confirm that no further deductions will be made and that any deductions made to date on disability benefit claims made since August 1982 will be refunded to this person.

According to the records of the Department, payment of disability benefit was made to the person concerned in respect of the period from August 1981 to August 1982. However, it appears that payment was issued in error. He was not entitled to benefit as he had already been paid his maximum duration on the basis of his insurance at that time. Having regard to the circumstances of the case, it has been decided not to pursue the overpayment that arose at that time and no further deductions will be made. A cheque for £89 in respect of deductions made from previous claims will be issued shortly.

asked the Minister for Social Welfare when a decision will be given in relation to the application of a person (details supplied) in County Cork for an invalidity pension.

Invalidity pension is payable to insured persons who satisfy the contribution conditions and who are permanently incapable of work.

The person concerned was examined on 2 May 1988 by a medical referee who did not consider her to be permanently incapable of work and asked to have her referred for a further examination in six months time. A deciding officer decided on 11 May 1988 that she was not therefore entitled to invalidity pension.
