Vol. 382 No. 10

Supplementary Estimates, 1988. - Treaty on Extradition between Ireland and Australia: Motion.

I move:

That Dáil Éireann approves the terms of the Treaty on Extradition between Ireland and Australia signed in Dublin on 2nd September, 1985, as laid before the House on 27th June, 1988.

May I ask a question?

Certainly, Deputy.

Would the Minister confirm that the arrangements for the Attorney General do not apply to warrants under the Irish-Australian extradition agreement, that the Attorney General's intervening power has no function in these warrants?

This convention has been there, as I said, for almost 20 years but it was upset by the Trimbole case. We are just putting the matter right.

Do the arrangements in relation to the Attorney General's intervention apply to warrants for extradition to Australia?

Out of courtesy to the Deputy I answered the question. He now wants to be contentious so I will sit down at this point.

Question put and agreed to.
