asked the Minister for Health if his attention has been drawn to the concern expressed by the Employment Equality Agency regarding the low upper age limit for health service appointments; in view of the fact that this may result in indirect discrimination against older married women who may wish to return to the workforce, if he will review this practice in so far as it applies in the health service; and if he will make a statement on the matter.

I am aware that the Employment Equality Agency has referred under section 20 of the Employment Equality Act, 1977 certain age limit qualifications for employment in health boards and in public voluntary hospitals to the Labour Court. The Employment Equality Agency has been requested to furnish evidence to support its contention that the imposition of an upper age limit results in indirect discrimination on the basis of marital status. In this context, my Department is considering the matter.
