asked the Minister for Justice if the Gardaí are obliged to issue a report on the technical condition of any vehicle involved in a road accident which results in serious injury or fatality; and if he will make a statement on the matter.

I am informed by the Garda authorities that the gardaí examine all vehicles involved in road traffic accidents which result in a fatality or in a serious injury which it is considered may result in a fatality. In other accidents were serious injury is involved the gardaí examine only those vehicles which they have reason to suspect may be defective.

Persons involved in such accidents, their legal advisers or insurers and certain other interested parties may apply in writing to the Garda for an abstract of relevant Garda reports, including reports on examinations of vehicles concerned, and copies of statements. Once criminal proceedings have been disposed of such documents will be provided to such persons on payment of the appropriate fee.
