asked the Minister for Justice if he intends amending the laws relating to homeless persons, with regard to such offences as begging, drunkeness, being drunk and disorderly; and if so, in carrying out the reform of these ancient laws if he will take into consideration the difficulties facing these people and introduce penalties of a more humane nature which will also have the effect of helping in their rehabilitation.

The Law Reform Commission's Report on Vagrancy and Related Offences and on the Dublin Police Acts contain recommendations in relation to the offences to which the Deputy refers. Examination of those reports is proceeding as quickly as other urgent demands on my Department's resources permit and any legislative proposals which may arise therefrom will be announced by me in the normal way.

With regard to homelessness, the Deputy may be aware that the offence of wandering abroad without visible means of support was repealed by the Housing Act, 1988.

I might add that the offences referred to in the Deputy's question apply generally and are not related specifically to homeless persons.
