asked the Minister for the Environment, in view of the facts of a case, whether a "H" driving licence should issue to a person (details supplied) in Dublin 22; and if he will make a statement on the matter.

The Road Traffic (Licensing of Drivers) (Amendment No. 2) Regulations 1981 provide for the granting of a Class H licence to an applicant:

(a) who held a class D licence during the five year period ended on 30 June 1981, or

(b) who held a Certificate of Competency to drive vehicles of Class D on 30 June 1981,

(c) provided the application is accompanied by a certificate, on the scheduled form, to the effect that the applicant had driven articulated vehicles for not less than 65 days during the period of five years prior to the application or

(d) held a licence to drive vehicles of Class D on the 30th day of June, 1981, and his application is accompanied by a statement by the applicant's employer, or where he was self-employed, by the applicant, that on the 30th day of June, 1981, his employment or occupation was such as to require him to drive articulated vehicles and that he drove vehicles of that class in such employment or occupation.

The person referred to by the Deputy does not fulfil the requirements at either (c) or (d) above and consequently cannot be issued with a class H licence.
