Written Answers. - European Court Finding on Oil Consumption.

asked the Minister for Energy the implication of the European Court finding on the compulsory sourcing of one-third of Irish oil product consumption from the Whitegate Oil Refinery, County Cork.

The European Court decision, delivered on 10 July 1984, to which the Deputy's question refers, states that the mandatory regime is permissible under certain circumstances under Article 36 of the European Treaty on grounds of public policy and public security.

The Deputy will appreciate that in view of the fact that the decision of the court is part of legal proceedings which have not, as yet, been concluded or withdrawn by the plaintiffs from the High Court, it would not be appropriate for me to comment further on this matter.
