Vol. 392 No. 9

Written Answers. - Extradition Act, 1987.

37.

asked the Minister for Justice if he will elaborate on the report by the Attorney General on the operations of the Extradition Act, 1987, in respect of the year 1988, as laid before Dáil Éireann; in particular, if he will set out the criteria employed by the Attorney General in exmaining warrants; and if he will make a statement on the matter.

The Government's report to the Oireachtas under section 6 of the Extradition (Amendment) Act, 1987, is a full, factual statement of the operation during 1988 of Part III of the Principal Act of 1965.

It is not clear what exactly the Deputy has in mind when he inquires about the criteria employed by the Attorney General in examining warrants. All extradition warrants and accompanying documentation are examined by the Attorney General with a view to ensuring that they comply with the requirements of Irish law. If the Deputy has in mind the criteria employed by the Attorney General in implmentating the safeguards introduced by the 1987 Amendment Act, I would point out that these criteria are set out in section 2 (1) of that Act.
