Question:

39 Mr. Rabbitte asked the Minister for the Environment if his attention has been drawn to the findings of a recent survey published by the Environmental Research Unit, which showed that up to 44 per cent of developments did not conform with planning permissions granted; the steps he intends to take to ensure full compliance with all planning permissions; and if he will make a statement on the matter.

I am aware of the report in question (which was carried out by the Environmental Research Unit on behalf of my Department). The report represents the findings of a 1 per cent sample survey of 1986 planning applications and a follow-up check on the development carried out on foot of these applications. The survey encompassed some 390 planning applications across 15 of the 87 planning authorities and covered many aspects of the operation of the planning system, of which the rate of compliance is but one. I will be taking up the overall question of enforcement with planning authorities in accordance with their statutory functions under the Planning Acts.
