Question:

150 Mr. Gilmore asked the Minister for the Environment whether, in view of the decision taken by An Bord Pleanála in a particular case (details supplied), it is proposed to implement sections 6 and 15 of the Local Government (Water Pollution) (Amendment) Act, 1990; if so, whether he has taken any steps to instruct the board in the proper exercise of their functions; and if he will make a statement on the matter.

156 Mr. Gilmore asked the Minister for the Environment the number of orders made to date under section 31 (4) of the Local Government (Water Pollution) (Amendment) Act, 1990; the sections of the Act to which each order applies; and the date on which it came into effect.

I propose to take Questions Nos. 150 and 156 together.

No order has been made under section 31 (4) pending the completion, anticipated for early 1991, of comprehensive procedural regulations connected with the provisions to which section 31 (4) applies. These provisions include sections 6 and 15 of the Local Government (Water Pollution) Act, 1990, which will be brought into operation as soon as these procedural matters are catered for.
It would not be appropriate for me to comment in relation to the exercise by An Bord Pleanála of their functions in a particular case.

151 Mr. Gilmore asked the Minister for the Environment the number of regulations made to date under section 26 of the Local Government (Water Pollution) Act, 1977; the date on which each such regulation was made; the local authority area in which it applies; and the specified effluent, classes of effluent, or waters specified by reference to their use, dealt with in each regulation.

153 Mr. Gilmore asked the Minister for the Environment the number of regulations made to date under section 4 (1) of the Local Government (Water Pollution) Act, 1977; the date on which each such regulation was made; the local authority area in which it applies; and the specified effluent, classes of effluent, or waters specified by reference to their use, dealt with in each regulation.

I propose to take Questions Nos. 151, 152 and 153 together. The information requested is set out in the following table:

154 Mr. Gilmore asked the Minister for the Environment whether directions have issued to local authorities under section 21 (2) (b) of the Local Government (Water Pollution) (Amendment) Act, 1990; and if so, if he will indicate in the case of each such direction (a) the name of the authority concerned and (b) the date of issue of the direction.

155 Mr. Gilmore asked the Minister for the Environment whether the guidelines which the Minister of State at his Department referred to, during the Committee Stage debate on the Local Government (Water Pollution) (Amendment) Act, 1990, (details supplied), provided to local authorities to assist them in making bye-laws under section 21 of that Act, have issued; and, if so, whether copy of these guidelines can be made available for the information of Dáil Éireann.

I propose to take Questions Nos. 154 and 155 together. My Department have already directed the special attention of local authorities to their new powers to make bye-laws under section 21 of the 1990 Act and have requested them to consider the need to avail of these powers. When the responses of local authorities are to hand I will assess the situation and the need to issue directions under section 21 (2) (b).

Local authorities already have at their disposal guidelines and recommendations on the control of pollution from farmyard wastes (with particular reference to storage aspects) which were prepared by the Department of Agriculture with input from my Department. With a view to facilitating the making of section 21 bye-laws, I intend to supplement these guidelines as soon as possible with further advice on the environmental control of farming activities.
