Question:

163 Mr. Howlin asked the Minister for the Environment if he has made a decision in relation to the request from a person (details supplied) in Wexford to hold a public inquiry into a disputed right of way; and if he will make a statement on the matter.

Following receipt of the request referred to by the Deputy, my Department asked Wexford County Council for a report. In so far as the council can establish there is no evidence to suggest that a public right of way exists over Coiner's Lane. Since my only relevant statutory function relates to the approval of a local authority proposal to extinguish a public right of way, I regret I cannot be of any further assistance. In cases such as this, the issues involved may, in the absence of agreement between the parties, have to be resolved by recourse to the courts.
