Written Answers. - Single Market Directives.

Question:

87 Mrs. Fennell asked the Minister for the Marine if he will indicate the legislative measures his Department must take consequent to EC Directives in preparation for the open market in 1992.

With regard to the completion of the open market, it is necessary for my Department to take legislative measures in respect of the following EC Directives:

(a) "Council Directive concerning the animal health conditions governing the placing on the market of aquaculture animals and products."

(b) "Council Directive concerning the health conditions governing the production and placing on the market of fish and fishery products."

(c) "Council Directive concerning the health conditions governing the production and placing on the market of live bivalve molluscs."

Details of the legislation requirements are as follows:

Directive (a)

I will have to give effect to this Directive by means of Regulations under the European Communities Act; the Regulations will cover the categorisation of fish diseases, the zoning of areas in accordance with fish health status under the various categories and will in addition make provision in relation to controls on the movement of fish between zones. The objective is to minimise the risk of spreading fish disease within Ireland and the European Community generally, given the removal of border controls.
Directives (b) and (c)
As soon as these Directives are adopted by the Agricultural Council it will then be necessary for me to bring in a regulation under the European Communities Acts to make it possible to implement the requirements of the Directives.
