Vol. 409 No. 1

Marine Matter.

In late 1990 the Minister for the Marine made an order revoking the 1975 agreement between the Department of Communications — then the appropriate Department — and the farmers' local development association and the golf club in Ballybunion which allowed individuals to take sand from the beach in Ballybunion under certain conditions. As these conditions were not being complied with the Minister, after considerable pressure, made a prohibition order last year. However, it was later discovered that a licence existing since 1977 allowed two individual farmers to take sand from the beach. This was not covered by the order made in October. This licence has given rise to the problem and the indecision of the Department of the Marine, which allows the beach to remain open and sand to be taken at present.

The local people are very concerned. Ballybunion beach lost its blue flag last year and failed to regain it this year because of bad beach management. This is a serious blow to the morale of the people of Ballybunion village, which has suffered a decline over the past ten years. The people are fighting back and doing their best. However, the beach is the attraction and provides the main source of livelihood. It must be preserved if they are to have any hope of winning the fight against adversity.

Is mian liom tagairt don díospóireacht sa Teach seo ar 20 Feabhra a chuaigh thart. Ag an am sin chuir mé béim ar an bfíric go raibh mé buartha mar gheall ar dhaoine bheith ag tabhairt gainimh ón trá ag Ballybunion agus go mbeinnse ag iarraidh fuascailt na faidhbe seo a fháil.

I pointed out that in accordance with the provisions of the Foreshore Prohibition of Removal of Beach Material (No. 2) Order, 1980, which was made by me on 1 November 1990 and to which the Deputy referred, removal of beach material from the area in question is prohibited at all times, save in accordance with a licence issued under the Foreshore Act, 1933. The order does not, as I indicated to the House on 20 February, invalidate the foreshore licence granted in 1977 to the trustees of the committee of the farmers of six parishes in North Kerry. That licence authorises the removal of beach material from Ballybunion, subject to certain conditions, and is due to expire on 31 December 1995.

In relation to the licence and in relation to the state of the beach generally, I have received various statements alleging breaches of the terms of the licence. I have accordingly notified the solicitors representing the trustees that I propose to revoke the licence in question. The licensees were given 21 days in which to respond to the notice and this response has now been received in my Department. I am assessing this response in consultation with the Attorney General before making a final decision on the matter. The Deputy will appreciate that I may add nothing further at this stage and that I aim to be in a position to reach a decision as a matter of urgency.

The Dáil adjourned at 10.30 p.m. until 10.30 a.m. on Wednesday, 29 May 1991.
