Written Answers. - Food Hygiene Regulations.

Question:

218 Mr. Callely asked the Minister for Health if he will outline the level of fines levied for breaches of food hygiene regulations; and if he will make a statement on the matter.

The penalties for breaches of the Food Hygiene Regulations, 1950-89 are as set out in the Health Acts, 1947-70.

Generally speaking, persons who contravene a regulation are liable on summary conviction to a fine not exceeding £100 and in the case of a continuing offence to a further fine not exceeding £10 for each day on which the offence is continued or, at the discretion of the court, to imprisonment for any term not exceeding six months or to both such fine or fines and such imprisonment.

The level of fine imposed in cases where prosecutions have been taken by the health boards for breaches of the food hygiene regulations can and does vary as ultimately it is a matter for the courts to decide.
