Question:

98 Mr. M. Higgins asked the Minister for Justice the remedies which are available to people to gain redress, other than legal actioni, where entries in the Land Registry have been the basis for forgery or inaccuracy.

Section 32 (1) (a) of the Registration of Title Act, 1964, provides for the rectification of errors in registration originating in the Land Registry, whether by mis-statement, mis-description, omission or otherwise. Rule 8 (a) of the Land Registry Rules, 1972 provides for the correction of a clerical error in a register or registry map. Furthermore, provision is made in section 120 of the Registration of Title Act, 1964, and Part V of the Land Registration Rules, 1972, for compensation payable out of the Central Fund for error, forgery or fraud in relation to registration.

Persons becoming aware of errors in entries in the Land Registry records should notify the Registrar of Titles, Land Registry, giving appropriate details.
