Question:

128 Mr. Creed asked the Minister for the Environment if he will outline the legislation, if any, which governs permissible noise levels; and if any relevant EC Directives have issued in this regard.

Controls in regard to neighbourhood noise are provided for under the Planning Acts which also allow conditions to be attached to planning permissions to regulate emissions from, or intrusion into, structures of noise or vibration. The Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963 provide for controls on vehicle noise. There are various EC Directives providing for common controls in relation to permissible noise levels from certain construction, domestic and other equipment.

Provision to improve the law in relation to noise is included in the Environmental Protection Agency Bill.
